CAR ACCIDENT FAQ

Briefly, some factors that may impact whether you should contact a personal injury lawyer include whether you have injuries, how badly you are injured, and whether you are liable or partly liable for the accident. (Note that you may still have a claim even if you are partially at fault.)

The best way to determine if you have a valid personal injury claim is to take our personal injury quiz. It only takes a few minutes, and we’ll let you know if arranging a consultation with a car accident lawyer is the right next step for you.

If you’re involved in a car accident, the first thing you need to do is make sure you’re safe and out of traffic, if possible. Once you’re safe:

  • Seek medical advice, even if your injuries seem minor. This is important for you to recover effectively, and it documents any injuries.
  • Call the police to report the accident.
  • Get contact details and insurance details from the other parties involved and any witnesses.
  • Contact a motor vehicle accident lawyer as soon as you can, even before you contact your insurer.

For more information about what to do next, review our getting started guide.

You may be eligible for the following types of compensation following a motor vehicle accident in Alberta:

  • Medical expenses
  • Pain and suffering
  • Lost wages
  • Loss of future income/earning potential
  • Household labour
  • Future cost of care
  • Property damage.

The type(s) of compensation you may be eligible for depends on your unique injury and how you were injured. To learn more about the types of compensation you’re eligible for following a car accident, schedule a free consultation with the team at James H Lawyers & Associates.

This will vary depending on the circumstances but there are several possibilities. In Alberta, generally, as an adult, you will have two years to bring your claim from the date of the accident.

Alternatively if for some reason you didn’t know or ought to have known your injury was due to actions or omissions by the other party the ultimate limitation period set by the Alberta Statute of Limitations is ten years. Meaning if you didn’t know or ought to have known about the source of your injury and you were an adult you would have ten years to bring the claim.

You can learn more about limitation periods for motor vehicle accidents.

Yes, you may still be able to pursue compensation following a car accident even if you were partially at fault. This situation is considered by Alberta’s Contributory Negligence Act. In general, the amount of compensation you receive may be adjusted relative to your level of fault for the accident.

This is a complex area of the law, so it’s worthwhile speaking to a qualified car accident lawyer to work out if you have a claim. Start with a free consultation with our team.

We often work with people who have been injured in the following types of car accidents:

  • Head-on collisions
  • Rear-end collisions
  • T-bone or side-impact collisions
  • Multi-vehicle pileups
  • Rollover accidents
  • Accidents caused by drunk or distracted driving
  • Hit-and-run accidents.

If you were injured in a car accident, reach out to a qualified lawyer as soon as possible. Your car accident injury lawyer can protect your rights and fight for fair compensation, freeing you up to focus on your recovery.

Car accident settlements are varied, and no ‘average’ settlement amount exists. Here are some of the factors that can impact your settlement:

  • How early you contact a car accident injury lawyer.
  • How and why the crash happened.
  • The severity and long-term impact of your injuries.
  • Medical evidence.
  • Your lost wages, medical bills, and other costs.
  • Your legal strategy for managing your car accident claim.
  • And a range of other unique factors depending on your case.

Compensation for pain and suffering is an area of law that has become highly complex in Alberta.

In October 2004, the Alberta Government passed the Minor Injury Regulations and the Diagnostic and Treatment Protocols. These laws collectively attempt to cap or limit damages for pain and suffering to a current maximum of $5,488 for Grade I and II strains, sprains and whiplash (WAD) injuries suffered as a result of a motor vehicle accident. Grade I and II strains, sprains, and whiplash (WAD) involve the muscles and ligaments. Other injuries including nerve and tendon injuries and temporalmandibular joint dysfunction (TMJ) are not expressly capped. Injuries from non-motor vehicle accidents are not capped.

The caps on pain and suffering are limited and should be determined on a case-by-case basis. We generally see higher awards for pain and suffering in situations where the injured person has received significant, life-altering injuries in an accident. So it’s important that you do not rely on what you are told by an insurance adjuster without first speaking with a qualified car accident lawyer.

Even if it initially looks like your claim will fall under the Cap, your injuries may be such that your claim will eventually fall outside the Cap. If you or a family member suffer a soft tissue injury in a motor vehicle accident, your best course of action is to consult with one of our experienced accident injury lawyers who will advise you on how best to proceed.

The length of time depends primarily on the nature of your injuries. We strongly advise all of our clients not to settle their claims until they know the final outcome of their injuries and how these injuries may affect the rest of their lives.

Often, we are able to achieve a settlement within a relatively short period of time after receiving a medical report indicating our client is fully recovered. However, if an insurance company is being unreasonable, it is sometimes necessary to proceed to the courthouse steps, or even to trial, in order to achieve a fair settlement for our client.

Our team of experienced accident injury lawyers at James H. Brown & Associates can provide a more accurate estimate of how long your case will take after speaking with you about the details of your case. This initial consultation is free of charge.
