XL Foods Class Action

The class action was commenced in connection with the fall 2012 recall of beef products processed at the XL Foods facility in Brooks, Alberta. The recall was issued as a result of a possible E. coli contamination and is the largest food recall in Canadian history.

May 9, 2019 – Important Update
The claims process is now complete. The Claims Administrator had advised that cheques will be issued on approved claims in May of 2019.

January 15, 2019 – Important Update
The court-appointed referee has now issued decisions on the 12 appeals that were filed. The deadline for a party seeking a review of an appeal decision is February 7, 2019. If no review applications are filed, the Claims Administrator will issue cheques thereafter.

October 25, 2018 – Important Update
The Court is working on the appeal decisions. There is no updated timeline for when the decisions will be issued. Thank you for your patience.

July 9, 2018 – Important Update
The appeal decisions remain pending at this time. We do not have an estimated time which we can provide in terms of the expected date for receipt of the appeal decisions. A further update will be posted as soon as we have more information. Thanks for your patience.

March 28, 2018 – Important Update
The appeal process should be complete by June 30 with cheques to be issued by the claim administrator shortly thereafter.

February 26, 2018 – Important Update
The claims process is complete except for the hearing of appeals filed. The Court has appointed a Referee to hear the appeals. It is anticipated that the appeal process will be completed over approximately the next four months with cheques for approved claims being distributed by the Claims Administrator thereafter

​$4 million settlement in class action approved for distribution

TORONTO, Feb. 17, 2016 /CNW/ – Siskinds LLP of London, Ontario, James H. Brown and Associates of Edmonton, Alberta and D’Arcy & Deacon LLP of Calgary, Alberta announced today the court approval of a protocol for the distribution of settlement funds in the XL Foods class action. The class action was commenced in connection with the fall 2012 recall of beef products processed at the XL Foods facility in Brooks, Alberta. The recall was issued as a result of a possible E. coli contamination and is the largest food recall in Canadian history.

A settlement in the amount of $4 million has been reached with XL Foods to resolve the litigation in its entirety. XL Foods do not admit any wrongdoing or liability. The Alberta court approved the settlement and a protocol for distribution of the settlement funds.

Persons in Canada or the United States who purchased and/or consumed recalled XL beef or who purchased beef that could not be positively identified as not being recalled XL beef are eligible to claim settlement benefits.
